The Tattoo Circus is a DIY organized festival against repression and imprisonment. The Tattoo Circus began 2007 in Rome and since then activists from all around Europe (Barcelona, London, Thessaloniki, Bern, Athens, Madrid, Basel, Berlin… etc) took on the concept for supporting those people who can’t be among us. We are happy that this event will take place in Amsterdam as well and are sure it´s going to be an inspiring festival.

The idea behind this solidarity event is to create a space where tattoo culture and political involvement come together. Several tattoo artists will provide their creativity, experience and as much ink as possible, in order to support the anti-prison struggle and to become a part of it. The principle of the Tattoo Circus is that nobody earns anything from this event, neither the tattooists, nor the piercers, the bands, performers or speakers, and the complete proceeds will go to those people who fight against the state and capitalism.

Every euro collected in Tattoo Circus goes directly to structures supporting prisoners and the Anti-Prison-Fight. Tattoo Circus won’t limit itself to the tattoo culture, therefore, a rich program is being prepared. It will include lectures, workshops, readings, info about prisoners, movies and so forth. We’ll also have an evening program with concerts, and there will be food and drinks.

As opposed to some established conventions, Tattoo Circus takes place in a non-competitive, non-commercial an non-hierarchical atmosphere and entrance is free for everyone.

We invite you to join, help and enrich this project. The full program will be published shortly.

The verdict was pronounced around 12:30, and she was immediately taken.

Since this past July the North Syrian city of Kobanê, in the central canton of the Autonomous territory of Rojava, has been under siege by ISIS. ISIS fighters, armed with modern U.S. manufactured tanks, artillery, and small arms have been held at bay by volunteer fighters affiliated with the militias of the Kurdish People’s
Protection Units (YPG) armed with dated small arms and improvised weapons.

Tens of thousands of residents of Kobanê, mostly ethnic Kurds, have been forced to flea to neighboring Turkey, made refugees in a country that has historically persecuted and oppressed them.

Hundreds of Kurdish volunteers have crossed the border from Turkey to help aid in the defense of Kobanê. Turkish soldiers and police have attacked those volunteers and observers, including international media, with teargas and batons, in attempts to seal off the border and prevent aid from reaching those struggling to hold the city against ISIS.

In response, anarchists from the Turkish anarchist organization, Revolutionary Anarchist Action (Devrimci Anarşist Faaliyet, DAF) have joined the efforts to keep the border open, as well as support those struggling in Kobanê and those made refugees from the fighting. DAF members are taking part in guarding the border against ISIS movements in and out.

Funds are urgently needed to support their work, especially to aid in the efforts to provide material aid for those who have been displaced by the conflict and forced to flee to Turkey.

We, as international allies of Devrimci Anarşist Faaliyet, call on all who see affinity with those struggling and suffering in and around Kobanê to help assist in these efforts. No amount is too small or too large. All funds raised will be sent directly to the DAF to be used as needed in their efforts.

In the evening of July 16th, 2014 comrades put up a solidarity banner at the gate of the Polytechnic School, on Patission Street, in response to the fact that Revolutionary Struggle member Nikos Maziotis was recaptured by police in central Athens.

Anarchist Nikos Maziotis, who was on the run for two years, was seriously wounded and arrested earlier today after a shootout with cops in Monastiraki. He was then transferred to the tightly-guarded Evangelismos hospital, where he remains hospitalized. According to his lawyer, the comrade’s life is out of danger.

From 22:30, dozens of anarchists gathered outside the hospital to demonstrate their solidarity with urban guerrilla fighter Nikos Maziotis. At about 23:30 the solidarity intervention was over, and an assembly was called for tomorrow, Thursday 17/7, at 19:30, in the Polytechnic School in Exarchia.

Komende donderdag 15 mei, dient bij het gerechtshof in Amsterdam het Hoger Beroep in de rechtszaak van de staat tegen Joke Kaviaar. Zij werd op 22 januari 2013 tot 4 maanden cel veroordeeld wegens het schrijven en verspreiden van vier teksten waarin zij de onderdrukking, vervolging, opsluiting en deportatie van vluchtelingen/ migranten zonder papieren, aanklaagt en tot actief verzet oproept.

Met de aanklacht en veroordeling wegens opruiing wil de staat het verzet tegen het onmenselijke asiel- en migratiebeleid afschrikken. Wij roepen daarom op om voor de rechtszitting in optocht vanaf de Dam naar het gerechtshof te lopen, terwijl we onderweg één van de verboden teksten, ‘Rara, wiens rechtsorde is het’verspreiden. Het verspreiden van door de rechtbank verboden geachte tekst kan door de politie als een strafbare activiteit worden aangemerkt, deelname aan de actie behelst dus een zekere kans op arrestatie op grond van artikel 132 (verspreiding tot opruiing).

Daarom hieronder wat juridische informatie.

Als je wordt opgepakt, vraag dan om deze advocaat en blijf ook om haar of hem vragen, ook al probeert de politie je wijs te maken dat deze advocaat het te druk heeft of dat ze diegene niet kan bereiken. Leg geen verklaring af. Je hebt het recht om te zwijgen, neem dit recht dan ook! Want alles wat je zegt over jezelf of andere mensen kan tegen jou of tegen anderen gebruikt worden.

Als je wordt gearresteerd voor een overtreding, bijvoorbeeld het betreden van verboden terrein, heb je niet het recht een advocaat te zien, met geluk kan je telefonisch met hem of haar spreken. Indien je je identiteit bekend maakt moet de politie je na 6 uur laten gaan (de uren tussen 12 uur ‘s nachts en 9 uur ‘s ochtends tellen niet mee, houd daar rekening mee), als je anoniem blijft (je krijgt dan een NN-nummer) kan je nog eens 6 uur worden vastgehouden.

Als je voor een misdrijf wordt gearresteerd heb je dus wel het recht je advocaat te spreken, voor het eerste verhoor. Voor sommige misdrijven kan je als je je bekend maakt maximaal 6 uur worden vastgehouden (bv. niet opvolgen van een ambtelijk bevel), voor andere misdrijven kan je in verzekering worden gesteld (bv. verzet bij arrestatie, vernieling). De inverzekeringstelling duurt maximaal 3 dagen. NN-ers kunnen altijd in verzekering worden gesteld. Na die drie dagen moet je worden vrijgelaten of voorgeleid worden aan de rechter-commissaris, die beoordeelt of je nog langer vastgehouden mag worden.

Soms worden mensen die anoniem blijven op het moment dat ze uit strafrechtelijke bewaring komen, gedreigd met vreemdelingenbewaring, omdat de politie hun identiteit en nationaliteit niet kent. Voor dat geval hebben we een vreemdelingenrechtadvocaat gevraagd stand-by te staan.

Bedenk je altijd voordat je naar een actie gaat of er dingen zijn die voor je geregeld moeten worden in het geval je wordt opgepakt. Als je werk moet worden afgebeld of je kat eten gegeven moet worden, zorg er dan voor dat er iemand is die dit kan doen en die het nummer heeft van de arrestantengroep. Als je besluit anoniem te blijven, zorg er dan ook voor dat er iemand is die weet waar je papieren zijn voor het geval je op een later moment besluit je identiteit wel kenbaar te willen maken. Als je medicijnen gebruikt, neem deze dan mee.

May 15: seditious action against prosecution Joke Kaviaar

Next thursday May 15, the appeal trial in the case of the state against Joke Kaviaar will take place at the high court in Amsterdam. On January 22, 2013, she was convicted to a 4 months jail sentence for writing and spreading four texts in which she denounces the oppression, persecution, incarceration and deportation of refugees/migrants without papers, and calls for active resistance.

With the charges and conviction for sedition the state wants to scare off the resistance against the inhumane asylum and migration policy. We therefore call for an action before the trial begins, to walk from Dam Square to the high court, while on our way we will spread one of the forbidden texts ‘Rara (Guess.. [1]), who’s legal order is it?’. [1] RARA was also the name of an action group that took radical action (like arson attacks) against migration policy and South Africa apartheid. So the use of the word RARA has a double meaning, which comes to light as you read the whole text.

Spreading the text that has been forbidden by the court can be considered a punishable act, taking part in the action means a considerable arrest risk because of article 132 (spreading seditious material).

Therefore here below some legal information.

If you are arrested, ask for the lawyer and keep asking, even if the police try to convince you that this lawyer is too busy or that they can not reach him or her. Do not make any statements to the police. You have the right to remain silent, use it! Because everything you say about yourself or other people can only be used against you or against anyone else.

If you are arrested for an offense, such as trespassing, you have no right to see a lawyer, with luck, you can call your lawyer. If your identity is known to the police they will have to let you go after 6 hours (the hours between 12 am and 9 am do not count, keep that in mind), if you remain anonymous (you will receive a NN number) they can keep you for another 6 hours.

If you are charged with a crime when you are arrested you have the right see your lawyer before the first time they interrogate/interview you. For some crimes can you be detained for up to 6 hours (e.g. non-compliance with an official order), for other crimes you can be held in custody; inverzekeringstelling (e.g., resisting arrest, vandalism). The detention lasts up to 3 days. People who remain anonymous can always be put in custody. After those three days you should be released or be brought to the investigating judge, who decides whether you will be held longer.

Sometimes people who remain anonymous are threatened with migrant detention when they are released from criminal custody, because the police do not know their identity and nationality. For this case we have a immigration lawyer on standby to assist.

Always think ahead before you go to an action whether there are things that you have to have arranged in case you are arrested. If your work must be called or your cat should be fed, make sure that there is someone who can do this and that this person has the number of the legal support group. If you decide to remain anonymous, also make sure that there is someone who knows where your papers are in case you decide later to reveal your identity. If you are taking medication, take it along.

Late the 14th and early the 15th of October 2013, five comrades were arrested and imprisoned in Skövde, Sweden, suspected for over twenty different attacks on fur farmers and the fur industry, as well as liberations of minks. Three of the comrades were later considered to be main suspects and the two others were released, however still being suspects. Close upon the trial startup, end of January, yet another person was detained for involvement in some of the suspected attacks but this person was also released, still being a suspect.

During their interrogations the three main suspects kept their mouths shut, besides one comrade who took the responsibility for a suspected arson against a garage belonging to a fur farmer.

Seeing the media potential the disgusting ex-minister of Justice Thomas Bodström, nowadays a populist lawyer, took on himself to represent all the fur farmers in the court process.

As the trial began in the end of January 2014, two of the comrades remained quiet and didn’t answer to any questions in court, just letting the assembled people know their denying position to the accusations through the voice of their defenders. The third person did however choose another approach, claiming his innocence, his aversion towards violence, as well as calling his close ones as witnesses to his advantage in the court process.

During the first day, the prosecutor scum used an interview from the anarchist zine UpprorsBladet no.3 as evidence against one of the comrades, claiming that he was the one being interviewed. His legal defense stated that there is no evidence-based connection between his client and the person being interviewed.

During the planned ten-days long trial the State posed an allegation that one or more of the accused were suffering from mental disorders. This, in the end, resulted in a six-week long psychiatric evaluation for the three of them, before any convictions could be made. On the 27th of March the main scum doctor of the State institution for (captive) psychiatric care declared all of them ”healthy enough to be sentenced to prison.”

Yesterday, the 31th of March, the last day of trial before conviction took place, and two of the comrades were released on bail. The remaining comrade, being the one who took the responsibility for the alleged arson, were to be kept in captivity as there were some aggravating circumstances concerning evidence around the arson and her involvement therein. The accusations of the two released comrades were, according to the court, not enough to motivate the continuation of an already six months long isolation in captivity; this being stated, although they considered the high likeliness of them evading the long arm of the law, continuing their criminal activities or both.

If the prosecutor gets her will done, the more talkative of the three would get 3 to 3,5 years in prison, and the other two at least 6 years in prison.

Besides showing our comrades the greatest of support for their ideas, their actions and their commitment to the liberation of animals, we find it important to comment on the use of our idea-based weapon against us and our comrades. For us, the enemy using our magazine against a comrade like this, is equal to us taking the service pistol of the State lackeys and point the gun barrel right back at them… This is not the first incident as such but this time we won’t let it be unanswered…

Sweden: Comrades in Skövde sentenced

On Monday the 7th of April 2014, our comrades in Skövde (Sweden) were sentenced.

The comrade who’s still kept in captivity was sentenced to 2 years and six months in prison.

One of those who were released last week was sentenced to 1 year in prison.

The other one, with the more talkative approach in court who was also released last week, was sentenced to probation.

Two more comrades that were on the outside received suspended sentences.

Even though the prosecutor creep didn’t get their will done, we see no reason to celebrate. Our comrades have spent half a year – more and less – in the disgusting pre-trial isolation cells, and they still have their sentences to either serve or evade.

As long as this society continues to exist, prison is and will be one of the worst weapons in the State’s arsenal. A weapon they are using every day in the social war against us and anybody who doesn’t fit in to their disgusting frames of normality. Prison is however not an end station but a continuation of our struggle against this reality. To maintain a struggle without including the prison and justice system as targets, is to shoot oneself in the foot.

This year on June 11 – the International Day of Solidarity with Marie Mason, Eric McDavid & all Eco-prisoners – we will be running the 2nd annual Never Alone online exhibition. It will serve as an avenue not only for fundraising for these political prisoners, but as a way to reach out informatively to a broad audience on issues of earth & animal liberation and state captivity. We would love to invite you to contribute an artwork to this exhibition.

June 11 started back in 2004 as the International Day of Solidarity with Jeff ‘Free’ Luers, an eco-prisoner sentenced to 22+ years in prison in Oregon (U.S.) for an act of arson against 3 light trucks in an effort to highlight the threat of climate change. This threat is now widely recognised, as was the incredibly unjust sentence that Jeff received. An international campaign of support had a massive impact on the fact that Jeff’s sentence was ultimately reduced to 10 years. By the time he was released in 2009 many other activists in the U.S. had been locked up in prison for standing up for a better world. Two of these prisoners – Eric McDavid and Marie Mason – had been sentenced to 20 and 22 years respectively. Both were sentenced severely for their willingness to fight for a world without oppression – be that of the earth, other animals, or our human communities.

Last year the Never Alone exhibition raised important funds for Marie and Eric’s support campaigns. We want to build on all the amazing support shown by artists and art buyers, and make this year’s exhibition an even bigger and more successful fundraiser. You can still see last year’s online exhibition [here].

Marie and Eric are contributing artworks for the exhibition, as well as a number of other amazing artists already on board. We are inviting a range of incredibly talented artists to contribute, whose art regularly touches on themes of liberation, wilderness and political action. We are very interested in contributions of original work, prints and small sculptures, and any other ideas that artists may have. Please feel free to get in touch and discuss with us any ideas you might have.

The exhibition will be online at www.neveraloneart.org, from June 11-30. It will be promoted heavily through our support networks, social media, and through other June 11 events being organised around the world. Artists involved would need to be able to provide suitable images of their artwork/s, as well as details of the dimensions, medium/s and price (incl. cost of postage within the U.S).

We are hoping that any artists involved will be willing to contribute between 100-70% of the sale of any artworks at the exhibition, with funds raised going directly to the support funds of Marie Mason and Eric McDavid. We would also require artists to be responsible for posting any sold artworks to the purchaser, with those costs being reimbursed to you by our collective.

CALL FOR A DAY OF MOBILIZATION

There are approximately 600 people accused, over a thousand investigated, dozens of people under several restrictions (home confinement, expulsion order), fines for hundreds of thousands of euros, a trial against 53 No Tav protesters, and several comrades who have been under house arrest for months now. These numbers show the repressive fury against the No Tav movement. This August, the Prosecutor of Turin added yet another chapter to their crusade: No Tav rotesters were investigated for “actions aimed at a terroristic attack” for one of the many actions taken against the construction site of Chiomonte – and for this reason subject to restraining measures.

After the No Tav fight was criminalized on the media for months, on December 9th, four protesters (Chiara, Mattia, Claudio and Niccolò) were arrested by the Prosecutor of Turin, who accused them of having taken part to an action against the construction site on the night between May 13th and 14th.

That night (as had happened on several other occasions) some of the tools and machinery present on site were damaged.

For the Prosecutor of Turin these are “actions aimed at a terroristic attack”. For us this is nothing but resistance.

The accusation of “terrorism” has very serious legal consequences. But this time the Prosecutor went even further and used, for the first time in Italy’s history, sections of the Penal Code that define any form of resistance to conomical and political powers as “terrorism”. According to Public Ministers of the Prosecutor Rinaudo and Palladino, in the face of everything the State imposes on us, one can complain but one cannot actively oppose it.

In other words, this frontal attack against the No Tav movement is a way to test a model that will then be applied to any form of strong, real dissent in order to defeat it.

In this scenario, everybody’s freedom is at risk.

For these reasons we are making a plea for everyone to rally this February 22nd:

• Against the accusations of terrorism and the criminalization of all fights.
• In solidarity with all the indicted and investigated No Tav comrades.
• For freedom for Chiara, Mattia, Claudio and Niccolò, and everyone still under house arrest.
• To start fighting again.
• Because those who attack some of us, are attacking all of us.
• To strongly reiterate that it’s impossible to stop us.

For all these reasons the NO TAV Movement announces a national day of rally on February 22nd where everyone shall fight in their territory.

This is for those who resist and oppose the waste of public resources, who are against the devastation of the land, and fight for the right to have a home, a respectable job, safe and paid adequately.

It will be a collective rally, in solidarity with all the imprisoned comrades, with the comrades who have already been condemned, to the countless comrades who are still resisting, waiting to face their trials, guilty of defending the common good.

This will be followed in March by another one, taking place in Rome, focused on the defense of social fights.

In preparation for this day of fight we encourage everyone to organize meetings and spread knowledge on these matters among people and what we are aiming to oppose.

LETTER FROM MATTIA, NICCOLO, CLAUDIO

It’s only four in the afternoon and the sun is setting behind the big metallic incinerator while in the distance it is possible to catch a glimpse of the nearest mountains of the valley and to imagine the profile of the Musiné. We have been detained for 10 days but still our thoughts travel far into the distance…

Everyone and their dog knew that the public prosecutor’s office of Turin was organizing something. The increasing number of charges against the movement was a clue and the biggest one was the intensive work of propaganda with which the investigators, the media and politicians tried to shadow the No Tav resistance under the magic word: “terrorism”. They talked obsessively about it for months, it was like a mantra that evoked a ferocious repression.

In the end, they used a few of the events from last summer adulterating and manipulating them in order to prove their vision of a world composed of soldiers, hierarchies, control and blind violence. And so, they justified the searches from last July and in the same way they justify our detention.

There is an abyss between what they want to see in us and what we really are. We don’t want to know the names of the ones who really went in the woods of Clarea that night last May in order to undermine the building site -probably, even the investigators don’t care about it. What they really want is to threaten the movement with years of jail in order to smoothly continue with their project in Susa. They would prefer people to stay home watching from their balconies the work in progress.

And yet, the people learnt how to oppose the work: we learnt how to block it when all together we shouted “No pasaran” and how to break the cement of the jersey when it was in our way; we learnt to look far away when the horizon was covered in tear gas and to stand heads held high when everything seemed lost.It won’t be the terror spread by them that will ruin the future harvest of this long fight.

We will need to keep building places and moments of discussion to exchange ideas and information, to make proposals and to be ready to go back in the streets and into the woods.

It’s evening here in Vallette. Apart from the darkness there is not much difference between evening and morning because the armored compartment is closed around the clock, 24/7: high security!

In comparison to Nuovi Giunti it’s calmer and cleaner but it’s the lack of human contact that debilitates us.
In the pit of the blocks B, C or F (Chiara is the only one forced in isolation)there are lots of stories and life experiences from which one can get complicity and solidarity.

Last month, Niccolò, who was arrested in late October for other proceedings, saw how the echo of the struggles against the TAV came into the jails and how it represents the courage of those who have ceased to undergo the choices of an overwhelming state.

For us, forced into isolation, it is vital to reject segregation and the separation of prisoners: we are all “common” (?).

For these reasons it would be nice if within the movement there could develop a reasoning about and against prison.
Most of the guards of Vallette live inside the jail, in big buildings within the walls… they won’t ever be free from it.

Even if they treat us politely, they won’t pull back from spying on us for their superiors when we will decide to fight for whatever reason.

And then, with the memories that we hold dear, we will let these “key holders/keychains” regret their narrowness.
“Have you ever seen the sea make its way through the woods on a beautiful afternoon in July and go against the nets of a building site?”

“Have you ever felt the warmth of shoulders of every age while the shields move forward, the asphalt on the highway becomes liquid and the rear fills with smoke?”

“Have you ever seen a snake with no beginning or end or a rain of stars in the middle of a midsummer night?”

We have and we are not yet satisfied.
The road is long, there will be exciting moments and big setbacks, we will move forward and then backward, we will learn from our mistakes.
For the time being, we look at our prison and it is not easy, but if “la Valsusa paura non ne ha” we neither will be fearful.

The world as they want it

The world they want is easily described in this way: someone stretched out on the seat of power who decides for everyone else; everyone has to accept the decision which has been made, silently with their head down;
those who do not agree with the leaders’ choices can show their dissent in limited ways but in the meantime these choices shall be respected.

The ones who dare to maintain their discord, by acting concretely and not only with words, will face police batons and legal measures. “This is democracy” they say; shame that they won’t say how rigged the system is, pity they hide the abyss that stretches out between common people and politicians who have close relationships with business men. No one has ever signed a contract approving the state of affairs. Basically, the state of affairs is imposed daily by propaganda, social blackmail and through the use of strength.

In Val di Susa.

Most likely, more than a few people will know about Val di Susa and the No TAV movement. What exactly are we talking about? We are talking about an entire population which has decided to stand against such a shameless project and who has been fighting for this cause for more than 20 years.

There are countless reasons against this ‘Massive/Great Work’/ “Grande Opere”:

• It’s useless: The railway line in Val di Susa has been recently renewed. Moreover, there has been a steady decrease in railway traffic.

• It’s harmful: the project (a 57 km tunnel) involves piercing mountains which are full of uranium and asbestos (harmless in nature if left untouched, whilst highly toxic if scattered in the air). Moreover, the project endangers the local ground waters/aquifers (as it similarly happened in Tuscany).

• It’s expensive: it is expected to cost 20 billion (the cost will probably increase according to the Italian custom), partly covered by European funds. Obviously, this money could be put to better use, such as in schools, hospitals, etc.

These reasons have been proven true by technical data, specialist opinion and university evaluations. Pages and pages that show how the only two big parties, Pd and Pdl, are the ones who directly express the only real interest in the construction of the TAV: the interest of the building companies, CMC (Pd) and LTF (Pdl). The former leader of the Pd party, Pierluigi Bersani, was a member of the administrative committee of the CMC. At the same time, the Minister of Infrastructure of the last Berlusconi government, Mr. Lunardi, was part of the most powerful firm which is currently working on the TAV: Rocksoil. Lastly, there is every politician’s friend, the contractor Mr. Ligresti. Clearly, “larghe intese” … “broad agreements”.

For these reasons, the people from Val di Susa started the No Tav movement. This movement has gained growing approval from every corner of Italy and from abroad, it became an example of a new way of living, resisting and thinking freely toward an alternative world.

During the years, especially since 2005, lots of things were done: oceanic demonstrations and walks in the woods, petitions, legal appeals and camping, as well as prayers in churches and witches’ sabbath. Every time the construction site starts to work the voices of the dissent become concrete gestures opposing the TAV. The government militarized the area, sending hundreds of policemen and soldiers, hundreds of charges, “fogli di via”, tear gas fired in the protester’s faces, blows, batons…

Who is the terrorist?

During the night between the 13th and the 14th of May 2013 someone slipped in the construction site of Chiomonte and set fire to some machines. An attack, a sabotage, as there have been dozens in recent times. For this reason, on the 9th December 2013 four arrests were performed, three of them in Turin and one in Milan, on charges of having participated in the attack and on charges of terrorism.

We don’t want to know if the people arrested, people we know and love, are responsible for the events of last May. We know that a “terrorist” is someone who strikes indiscriminately on the population, who bombards and who starts wars, who destroys the land, who intoxicates protesters with tear gas CS (forbidden by international conventions on chemical weapons) etc. Obviously, a “terrorist” is not someone who has an ideal and who fights to grab a better life, one without the exploitation of man.

Last Sunday, in a crowded square of Bussoleno, a nice town just outside Susa, a woman said loud and clear: “These four boys are our sons. They are the sons of the Valley, the valley of the resistance. We want them free, NOW!” Mattia is one of them. He is one of them.

*Notes on the last No Tav arrests*

There was something in the air. This past December 9th comrades Chiara, Mattia, Claudio and Niccolò were arrested and accused of attempting todismantle a part of the TAV (Turin-Lyon high-speed rail ) construction site of Chiomonte on the night between May 13th and 14th, 2013.

Nobody knew who inside the movement was going to be damaged by this and for what particular reasons. But the way the TAV supporters responded in the press and all major media left no space for doubt – it was clear there were going to be major consequences.

Another red flag was the fact that Chief Prosecutor of Turin, Giancarlo Caselli, announced he would retire early: it’s hard to believe that such a prominent figure would leave the scenes so quietly.

After spending the summer leading investigations into several No Tav protesters for “actions aimed at a terroristic attack” pursuant to article 280 of the Italian Penal Code, the two Public Ministers of the Prosecutor of Turin, Andrea Paladino and Antonio Rinaudo, succeeded in arresting Chiara, Claudio, Mattia and Niccolò this fall. They followed the path of Prosecutor Caselli, who had previously ordered the arrests and trials against No TAV protesters (approximately 500 were persecuted, and there were more than 50 trials).

Besides article 280, the four comrades were charged with “Terrorist action and use of deadly weapons or explosives, causing damages by starting a fire, violence against public official, illegal detention and transport of war weapons”.

These accusations don’t allow for the use of alternative measures of detention such as house arrest or mandatory residence, but instead call for prolonged and preemptive incarceration. Should the charges remain as they are after the initial trial, the accused could be sentenced for twenty or more years of incarceration.

More specifically, the four arrested comrades have been accused – along with others who are “currently being identified” – of attempting on the life and safety of the construction workers and the police on site, “thus forcing the public power or an international organization to perform or abstain from performing any acts” (i.e. financing and building the high-speed rail between Turin and Lyon) “and causing great damage to Italy and the European Union” says article 270.

However on the night between May 13th and 14th no workers, policemen or soldiers were even slightly injured, and there are no medical reports from that night. It is important to look at previously cited article 270 more closely.

After the massacres that took place in Madrid in 2004 and London in 2005, and taking advantage of the emotional wave those events had caused, in July 2005 the Italian government – specifically Minister of Internal Affairs Giuseppe Pisanu – created a new set of laws that redefined and widened the concept of “terrorist conduct”. These new laws were allegedly formulated as a consequence of the Madrid bombings (and forced Zapatero to withdraw the Spanish troops from Iraq), and were purposefully left vague.

From the beginning, both comrades and lawyers were aware of how these new, vague rules would have penalized No Tav protesters and any other fighters.
The use of article 270 against this movement is not fortuitous; it is the intentional application of a law that was specifically created to obstruct social conflict.

And it’s no accident that they would use this measure for the first time to defend the construction site of Chiomonte, where the presence of Israeli barbed wire, soldiers, and tanks from Afghanistan were already making this internal conflict look like an external war.

That night, a generator, the power supply for an air vent, several power supply cables and an extension pipe for the vent itself were set on fire.
All of this equipment was necessary to the realization of an exploratory tunnel. These damages were active obstacles and forced the work to slow down.

This act wasn’t indiscriminate at all; rather, it was direct and it precisely stated its objective.

It was exemplary sabotage; a stone was thrown into the machine, and jammed it.

And, as their public announcements during the days following the act show, these were the clear intentions of the No Tav fight. For the first time in Italy in at least thirty years, a mass movement was reclaiming the validity of sabotage. In reality, which is far from that of “justice” and legal documentation, the movement took on sabotage as their main tool because any of the constant and unequivocal displays of discord and opposition to the realization of this major infrastructure from the masses has been ignored systematically.

The fact that the construction site for the exploratory tunnel suddenly became a “site of strategic national interest” is yet another proof of that. All of this, along with the exposure the fight in Val Susa, has made life difficult for the TAV party.

The idea of sabotage has become crucial in other contexts too – for example the No Muos fight in Sicily – and intensified the concerns and preoccupations for the “mother of all preoccupations”, as Cancellieri-Ligresti said (Justice Minister Annamaria Cancellieri defended her friend Giulia Ligresti, daughter of a former insurance magnate, after she was accused of fraud).

We should examine this investigation in this light.

After the 12/9 arrests, many pointed out how the accusations of terrorism were widely discussed by the press in an effort to create divisions within the movement. It’s the same scenario that followed the guerrilla attacks that took place in Val Susa on July 3rd 2011, which used the slogan “we’re all black blocs”; suddenly there were good guys vs. bad guys, pacifist inhabitants of the valley vs. extremists. But this attempt to isolate the four arrested comrades failed miserably.

The investigators themselves didn’t doubt it anymore: these accusations of terrorism served another purpose.

The authorities turned the legal content of the inquiry into a political treatise. It starts with a brief history behind the construction site of Chiomonte, of the laws and international meetings that made it possible; the magistrates describe it as a democratic procedure. The action taken against the building site is called “terrorism” not because of its specific characteristics but rather as it is in direct conflict with a democratic, intergovernmental decision.

Let’s try to follow this logic then.
Everything the State imposes on us has a strong legal basis, is rooted in the law.
Everything that contrasts a national project can then be defined as “terrorism”. What’s left is nothing but platonic dissent. Turning your ideological opposition into something tangible, which is exactly what the No TAV fight did, immediately becomes antidemocratic. Benito Mussolini used to say “nothing outside the State, nothing against the State”.

Today totalitarianism speaks a different language. You don’t agree with a democratic imposition? You’re a terrorist.

Democracy is an armored door, shut to any form of opposition (with the exception of complaint, which is allowed).
And if the opposition refuses to stop, the same door is secured with barbed wire and soldiers.
The opposition then turns itself to sabotage, and that’s where the No Tav movement reveals “terroristic intentions”. In a way, Rinaudo and Paladino are explicitly expressing an idea that, up until now, had remained implicit: the decisions made by a democratic State are indisputable.

Any fight, whatever it may be, is always pushing the counterpart to “perform or abstain from performing any acts” (as expressed in article 270).

The so-called “social pact”, or the dialectic between different social groups, was officially founded on the idea that what is illegal today could be legal tomorrow. Since the post-war era the goal was to include peasants and workers into the “Great Compromise”: in other words, you give me labor, and we’ll give you rights. Well, that part of history is over now.

This is a Democracy: everything outside of and against it is Evil, is terrorism.
To say that this could be applied to any form of political movement is then banal.
Less banal is to draw the necessary consequences.
Throughout time, the ruling class has always directly attacked the enemy’s strengths, not their weaknesses. Labeling the No TAV action – and all that this movement expresses and symbolizes – as terrorism, is a warning to all.

If you follow Rinaudo and Paladino’s logic closely, you’ll notice how the terroristic nature of the fight against TAV doesn’t lie in its quality, but in its premises; it lies in the loud and decisive “NO”, a strong rejection that is the logical result of twenty years of experiences, learning, discussion and action.

The real crime the government is punishing is the refusal to give up despite the batons, tear gas, bulldozers, tanks and media terrorism: the perpetual fight *is* the crime.

For these reasons, defending the comrades under arrest is not just an obligatory act of solidarity, but rather a stubborn claim of this fight and its reasons for existing.

Understanding what’s at stake with this repressive operation and continuing to resist, in Val Susa as well as everywhere else, is everyone’s responsibility.

While writing, Jock Palfreeman is already more then 5 years imprisoned in Sofia, Bulgaria for aiding two young Romani-boys when they were under attack from a group of right-wing hooligans. Palfreeman came into a fight with the group of fascists and two of his attackers got injured of whom one died later from his injuries.

We start this campaign because, next to the just move of Palfreeman to act, his court case was a total fraud in which he got convicted to 20 years of imprisonment. While in prison his treatment is worsening. One of the reasons for this is his support for other prisoners through the by him co-founded Bulgarian Prisoners Association. In the beginning of 2013 this was reason for depriving him from his right to finish his study in prison by the prison authorities.

In reaction to this Palfreeman started a hunger strike. A few months later (October 2013) there was another incident in which he and fellow prisoners were subjected to severe beatings by prison guards.

Meanwhile the Bulgarian state upholds a pretty picture about human rights, tolerance and its fight against xenophobia1. Through this the Bulgarian government is trying to present itself as a fitting partner of the o-so-tolerant bourgeois European Union. This same state is keeping Jock Palfreeman imprisoned while he stood up against a form of injustice that everyone should act against.

Everywhere in Europe we see an increase of right-wing and xenophobic ideas. On the wind of the social crisis and in the name of ‘freedom’ and as false saviors of ‘the people’, they are surfing as vultures around the rotting corpse of the capitalist bourgeois democracy. From Poland to Spain, from the Ukraine to Greece they try to win the inhabitants – terrorized by budget cuts and driven into disparity by social demolition by the IMF, the ECB and the EU – for their ideas. They try to put the crisis on scapegoats. Scapegoats like homosexuals, Jews and in many Eastern-European countries the Romani-communities2 . This while this specific group is often already living in harsh economic circumstances. It is in this light Jock acted.

There are, when analyzing such mechanics, many complex matters at work. A large part of the Eastern-European countries feels itself – understandably – for years discriminated and neglected. This region is dealing with a torn history of communist dictatorship and after that the trampling by capitalist elites, both ‘pro-Russian’ and ‘pro-European’. Meanwhile there has been a certain racism from West to East. The origins of the social and economic problems these fascist movements point out are disturbing and make clear all the more where the neglecting of an unprocessed history and a tormented past can lead to.

The antifascist struggle and the struggle for a social revolution together are the only path out towards true freedom for all peoples. In the struggle for social justice for everyone it is for its utmost importance to take a firm stance against all forms of discrimination. This way we can prevent, from West to East and also internally, that innocent minorities get the blame on base of their ethnicity, sexuality, social-economic position while we unmask and fight against the true origins of the problem: the international system of nationalism and capitalism; divide and conquer. The people in the front-lines of these struggle need our support.

We designed a poster (in English) to get international attention for the case of Jock Palfreeman and his current situation. This poster is currently being spread widely in Europe (Germany, Austria, Czech, Sweden, Norway, Denmark, Netherlands, Belgium, Spain, Portugal, Slovenia, Croatia). The poster is not only meant to inform the public but also to pressure the Bulgarian state. The Bulgarian state is currently vulnerable because of the attention it receives for the expiration of the need to have a visa in the EU for people with a Bulgarian passport. The Bulgarian state hopes when this works out well it can enter the EU-schengen-zone3.

Next to spreading information through the internet and via posters in the public space, we therefore also call for actions to put up the pressure against the Bulgarian government. They are thus far ignoring and frustrating the release of Palfreeman. Next to the pressure on the government for Palfreeman’s release this can also give him some new hope.

We ask to write the Bulgarian embassies with the demand for the release of Jock Palfreeman, send along posters to make clear the story is on the streets. This is not because we are seeing the Bulgarian state as a legit entity but they are the ones who keep Palfreeman hostage.
